These Terms of Service ("Terms") govern your use of Lifes a Gambol ("we," "us," "our"), a South Florida based poker community, online shop, and custom design services business operating at lifesagambol.com. By creating an account, placing an order, commissioning a custom project, or otherwise using the site, you agree to these Terms.
Please read them carefully. If you don't agree, don't use the site.
1. Acceptance of terms
By accessing or using lifesagambol.com, you agree to be bound by these Terms and by our Privacy Policy. If you're using the site on behalf of an organization, you're agreeing on behalf of that organization and confirming you have authority to do so.
2. Eligibility & age
Age requirements. Lifes a Gambol is a gambling-related site. You must be at least 18 years old to create an account or use the site, and 21 years old to engage with any gambling content other than poker. By using the site, you represent that you meet these minimums and that you're legally able to enter into a binding agreement.
By using the site, you represent that you meet these requirements and that you're legally able to enter into a binding agreement.
3. Your account
You're responsible for:
- Providing accurate information when you sign up.
- Keeping your password secure and not sharing it with anyone.
- All activity that happens on your account.
- Notifying us immediately if you suspect someone else is using your account.
We reserve the right to suspend or terminate accounts that violate these Terms, impersonate others, or engage in abuse.
You can close your account anytime from your account page. See the Privacy Policy for how long we retain data after closure.
4. Shop orders & products
Pricing & availability
All prices are in US dollars and exclude applicable taxes and shipping unless noted otherwise. We do our best to keep prices and inventory accurate, but errors happen. If we find a price or stock error after you order, we'll contact you and either honor the correct price, refund you, or cancel the order.
Order acceptance
Placing an order is an offer to buy. We accept the offer when we send an order confirmation. We reserve the right to decline, cancel, or limit orders for any reason, including suspected fraud, pricing errors, stock issues, or violations of these Terms.
Payment
Payments are processed securely through PayPal. We never see or store your card number. By placing an order, you represent that the payment method you use is yours and in good standing.
Sales tax
Florida sales tax applies to orders shipped within Florida. We collect additional state or local taxes where legally required.
5. Shipping & delivery
We ship from South Florida. Most in-stock physical products ship within 3-5 business days. Custom and made-to-order items have longer lead times noted on the product page or in your project agreement.
Shipping times depend on the carrier (typically USPS or UPS) and your location. Once a package leaves our hands, delivery time is subject to the carrier's schedule and conditions. We're not responsible for carrier delays, but we'll help you track down lost packages.
Risk of loss. Ownership and risk of loss transfer to you when the package is handed to the carrier. If a shipment arrives damaged, contact us within 7 days with photos and we'll make it right.
We primarily ship within the United States. International shipping, when available, is handled case-by-case; you're responsible for any customs duties, VAT, or import taxes your country charges.
6. Returns & refunds
See the full Returns Policy for details. In short:
- Standard products — returns accepted within 30 days of delivery, unworn/unused, with a receipt.
- Custom or personalized items — not returnable unless there's a defect or we made an error.
- Custom design services — governed by your project agreement; see Section 7.
7. Custom design services
We offer custom design and website-design services for clients. Each project is governed by a separate project agreement (statement of work) that spells out scope, deliverables, timeline, revision rounds, and fees. These Terms apply in addition to the project agreement; if anything conflicts, the project agreement wins.
Scope & revisions
Your project agreement defines the deliverables and how many revision rounds are included. Work outside that scope — "scope creep" — may require additional fees and timeline, which we'll quote in writing before starting.
Payment terms
Most custom projects require a deposit upfront (typically 50%), with the balance due before final files are delivered. Projects pause if invoices are more than 14 days past due.
Timeline
We commit to a timeline in your project agreement based on your timely feedback. If you delay responses or change direction mid-project, the timeline shifts accordingly.
Ownership & usage rights
- It's yours. On full payment, you own the work outright — full copyright, source files, working files, and any unused concepts we developed for your project. You can use it, modify it, adapt it, extend it, license it, or resell it however you want, with no ongoing license restrictions from us.
- No ongoing strings. We don't keep a residual license, kill-switch, or creative-control clause over the work you paid for. Once it's delivered, our involvement is done unless you bring us back in for more work.
- You own content you provide to us (logos, photos, copy, brand assets). You represent that you have the rights to use and share anything you give us.
- Third-party assets (stock photos, commercial fonts, paid plugins) are licensed under their vendors' terms, which travel with the work. If a project needs a specific paid license in your name, we'll tell you upfront so you can acquire it directly.
- Portfolio use. We may mention that we did the work and show it in our portfolio or marketing — this is about saying "we made this," not about retaining any rights to the work itself. If you'd rather we didn't show it publicly, just say so in writing and we won't.
Plain version: When we build something for you, it belongs to you. All of it. That's how we do business.
Cancellation & refunds
If you cancel mid-project, you're responsible for payment for all work completed through the cancellation date, and deposits for work already completed are non-refundable. If we cancel (which we'd only do in extreme circumstances), we'll refund any unearned fees.
Not a guarantee of outcomes
We design to the best of our professional ability, but we don't guarantee specific business outcomes, search rankings, conversion rates, or sales from any design project.
8. Community & user content
Our community forum and meetup RSVPs let you post content publicly. By posting, you agree to the following:
Your content, your responsibility
You retain ownership of what you post. By posting, you grant us a worldwide, non-exclusive, royalty-free license to host, display, and moderate your content as part of the service. You represent that you have the rights to post whatever you share, and that your posts don't violate anyone's rights or the law.
Community rules
- Be respectful. No harassment, threats, slurs, doxxing, or targeted abuse.
- No illegal content, piracy, or incitement to violence.
- No spam, scams, chain letters, or unauthorized self-promotion.
- No content sexualizing minors — this is a zero-tolerance rule.
- No fake news or deliberately misleading health, legal, or financial advice.
- Don't impersonate other people, our staff, or S.O.G.
- Keep gambling-strategy discussions honest — no rigged-system claims, "guaranteed win" systems, or coordinated advantage-play against individuals or venues.
Moderation
We may remove posts, lock threads, issue warnings, or ban users at our discretion. We don't pre-screen every post, so we're not responsible for user content — but we do reserve the right to moderate it when we become aware of problems.
9. Gambling content disclaimer
Entertainment and education only. Lifes a Gambol publishes content about poker, casino games, strategy, betting lines, and gambling news. This content is for entertainment and educational purposes only. We are not a casino, sportsbook, gambling operator, or licensed financial advisor.

You are solely responsible for your decisions to gamble, the amounts you wager, and the consequences of those choices. Know the laws in your jurisdiction — some games, stakes, and online activities are illegal in certain states or countries. Play responsibly. If gambling is harming you or someone you love, seek help from a qualified support resource.

11. Intellectual property
All content on lifesagambol.com that isn't user-generated — including the site design, logo, brand marks ("Lifes a Gambol," "Live boldly. Play joyfully.," ☘ mascots, slogans), editorial content, product photography, illustrations, and custom-designed materials — is owned by Lifes a Gambol or licensed to us. You may not copy, reproduce, modify, distribute, or create derivative works from any of this without our written permission.
If you believe content on the site infringes your copyright, send a DMCA notice through the contact form with: (1) identification of the copyrighted work; (2) identification of the infringing material; (3) your contact information; (4) a statement of good-faith belief that the use isn't authorized; (5) a statement under penalty of perjury that your notice is accurate and you're authorized to act; (6) your physical or electronic signature.
12. Third-party services
Parts of the site rely on third-party services — including PayPal (payments), Firebase (accounts, database), and various shipping carriers. Your use of those services is governed by their own terms and privacy policies. We're not responsible for third-party services' availability, performance, or conduct.
The site may link to third-party websites and social accounts. Those links don't mean we endorse the linked content, and we're not responsible for what you find there.
13. Disclaimers
THE SITE AND ALL PRODUCTS, SERVICES, AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND TITLE.
We don't warrant that the site will be uninterrupted, error-free, secure, or free of viruses. We don't warrant that any information on the site is accurate, complete, or current. You use the site at your own risk.
14. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LIFES A GAMBOL AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING FROM YOUR USE OF THE SITE, REGARDLESS OF THE LEGAL THEORY.
OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO YOUR USE OF THE SITE IS CAPPED AT THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR $100, WHICHEVER IS GREATER.
Some jurisdictions don't allow the exclusion or limitation of certain damages, so these limits may not apply to you.
15. Indemnification
You agree to indemnify and hold harmless Lifes a Gambol and its owners, employees, contractors, and partners from any claim, loss, or expense (including reasonable attorney's fees) arising from: your use of the site; your violation of these Terms; your violation of any law or anyone else's rights; or content you post on the site.
16. Termination
We may suspend or terminate your access to the site at any time, with or without notice, for any reason — including violation of these Terms. On termination, your right to use the site ends immediately. Sections of these Terms that by nature should survive termination (such as intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.
17. Disputes & governing law
These Terms and any dispute arising from them are governed by the laws of the State of Florida, without regard to conflict-of-law principles. You agree that any lawsuit related to these Terms or your use of the site must be brought in a state or federal court located in Broward County, Florida, and you consent to the personal jurisdiction of those courts.
Before filing any lawsuit, you agree to contact us first and try to resolve the dispute informally for at least 30 days.
18. Changes to terms
We may update these Terms from time to time. When we do, we'll update the "Last updated" date at the top of this page. Material changes will be announced on the site or emailed to you when we have your address. Your continued use of the site after changes take effect means you accept the updated Terms.
